FCC to vote on additional robocall rules
The FCC announced that they will vote on additional robocall and robotext rules at their open meeting on September 26, 2024. Let’s have a look.
New rules
Here’s a summary of the new rules:
- All U.S. providers in the call path must block using a reasonable DNO (Do-Not-Originate) list.
- Non-gateway intermediate and terminating providers must block substantially similar traffic identified by the FCC Enforcement Bureau in a Notice of Suspected Illegal Traffic.
- Establish a base forfeiture penalty of $11,000 per customer for any voice service provider that fails to take affirmative effective measures to prevent robocalls.
- Require exclusive use of SIP 603+ for notification of analytics-based blocking.
- The implementation deadline for SIP 603+ will be 12 months after the publication of the adopted rule in the Federal Register.
Update: On September 24, 2024, two days before the Open Meeting, the Commission deleted this topic from the agenda.
Some proposed rules will not be adopted currently
A few items that have been discussed in Further Notices of Proposed Rulemaking did not make the cut:
- No mandate for reasonable analytics.
- The Commission wants to see how it goes with SIP 603+ blocking notification first. They may revisit this issue later.
- No mandate to display the caller name when a provider chooses to display an indication that the caller ID has been authenticated.
- The Commission strongly encourages the industry to continue to make progress in using Rich Call Data (RCD).
- They may consider a mandate in the future if the industry does not make progress in deploying RCD solutions.
This set of rules would be the Eighth Report and Order for robocalls (CG 17-59) and the Third Report and Order for robotexts (CG 21-402).
