FCC to consider new rules for AI and robocalling

The FCC published draft rules for the use of Artificial Intelligence (AI) in robocalls and robotexts and will vote on them in their next meeting. Let’s have a look.

In their meeting on August 7, 2024, the Commission will vote on proposed rulemaking in the matter of Implications of Artificial Intelligence Technologies on Protecting Consumers from Unwanted Robocalls.

Here’s what the proposed rules would do:

  • Define “AI-generated call” as using technology to artificially generate a voice or text to communicate with a called party over an outbound phone call.
    • This includes computational technology, machine learning, predictive algorithms, and large language models (for example, ChatGPT).
  • Require callers making AI-generated calls to disclose that in their notice requesting consumer consent to receive calls.
  • Require AI-generated calls to disclose that at the beginning of each AI-generated call.
  • Exempt calls made by an individual with a speech or hearing disability.

In addition, the notice would seek comment on the following:

  • Technologies, either on the device or in the network, that can be used to detect incoming calls using AI-generated voice, alert the user in real time, and potentially block such calls.
  • Privacy implications of such real time AI call detection, alerting and blocking technologies.
